Road Hazzard / Tire Protection Program

Manufacturer/Vehicle Warranty Coverage:

Your new tire(s) are protected against defects in workmanship and materials by the tire manufacturer.  Manufacturers do not cover damage due to Road Hazards.  This coverage is secondary to the vehicle warranty, extended warranty and/or insurance policy of any kind.

Road Hazard Coverage:

This Tire Road Hazard Program is made by Convenience Auto Service, Inc.  This Road Hazard Program is extended only to you the original purchaser and the original vehicle identified on the receipt.  The Road Hazard Program is optional protection that must be purchased for each covered tire and must appear on your receipt. This is not a warranty, but rather a service contract.  This Road Hazard Program covers your tires for a term of 36 months from the date of purchase of the Road Hazard Program, or until any portion of the tire is worn to 2/32 of an inch or less, whichever occurs first.

What is a Road Hazard?

A road hazard occurs when a tire fails due to a puncture, bruise or break incurred during the course of normal driving on a maintained roadway, parking lot or driveway.  Nails, glass, potholes and road debris would be the most common examples.

Tire Care/Conditions of this Warranty:

Proper tire care is necessary to obtain the maximum mileage and wear from a tire.  Tires should be checked monthly for proper pressure, signs of dry rot and improper or excessive wear.  Tires should be rotated and balanced as outlined by the vehicle manufacturer.  All mechanical parts that effect your tires must be kept in proper working condition.

 

What You Must Do To Obtain Service:

1.  If you have a tire that has been damaged due to a road hazard as defined above and you are within a 25 mile radius of a Convenience Auto Service location, please contact the nearest location for specific instructions.  The process guidelines are listed below.  See contact information listed below. 

2.  If you have a tire that has been damaged due to a road hazard as defined above and you are outside of a 25 mile radius of a Victory Automotive Service location or it is after our normal hours of operation please have your tire inspected and serviced a tire service facility of your choice.  If the tire service facility determines that your tire is repairable have the tire repaired, pay for the repair and when you provide Victory Automotive Service with an itemized receipt we will directly reimburse you for this repair up to Thirty Dollars ($35.00).  If the tire service facility determines that your tire is not repairable be sure to have them measure and record the tires tread depth reading on your invoice.  If the tread depth reading has been taken and recorded you do not need to bring us the old tire.  However, you must pay for the tire replacement and submit an itemized receipt to us for reimbursement.  The reimbursement amount for a replacement tire shall not exceed the original purchase price of the tire including mounting and balancing with no exceptions.  The exact amount of reimbursement shall be determined by using the guidelines below.

Flat Tire Repair:

If your tire is damaged due to a road hazard and can be safely repaired, the tire will be repaired per manufacturer’s guidelines at any Convenience Auto Service location.  The repair will be provided to you free of charge.  The road hazard coverage for this tire will remain in effect until the end of this agreement.

Tire Replacement Terms:

If a tire covered by this Road Hazard Program cannot be safely repaired during the 36-month  term due to a road hazard as defined above, and there is more than 2/32” of tread remaining, you will be reimbursed with an exact make/model of tire if available.  If not available, a comparable quality tire will be installed.  When a tire failure occurs in the first 12 months of ownership and, in the opinion of the tire service facility, the tire cannot be safely repaired, the tire will be replaced.  When a tire fails after the first 12 months, the reimbursable amount is calculated by a pro-ration of elapsed time, not to exceed 36-months, based on the least of the original purchase price of the tire or the purchase price of the replacement tire.  For example, if the original price of your tire was $100, and the tire was damaged due to a covered road hazard in the 18th month of ownership, you would be reimbursed for the amount of time remaining in your Road Hazard Program, in this case 50% ($50.00).  You are responsible for any additional charges including but not limited to mounting, balancing, taxes and miscellaneous fees.  IF YOU DESIRE TO INCLUDE A REPLACEMENT TIRE IN THE ROAD HAZARD PROGRAM, YOU MUST PURCHASE A NEW ROAD HAZARD PROGRAM FOR THE REPLACEMENT TIRE.  When any portion of  the tread is worn down to 2/32 of an inch the tire is considered worn out and is not eligible for adjustment, regardless of the time in service.

Exclusions and Limitations:

The following vehicles are not eligible for coverage:  Any emergency service vehicle; any vehicle used for hire, commercial towing, construction or postal service; any vehicle used for farm, ranch, agriculture, or off-road use.  Coverage excludes any damage that occurs from off-road use (off-road use is described as driving on anything that is not a paved or gravel road maintained by the state or local authority).  Coverage excludes damage from vehicle collision, fire, vandalism, theft, snow chains, manufacturer’s defects, abuse and neglect (e.g. fenders, exhaust, and springs).  Also excluded are any tires that have been retreaded, recapped, regrooved, remolded, tubed or repaired in a manner other than per manufacturer’s guidelines.  This Road Hazard Program does not cover competition tires, LT Metric tires, LT Flotation tires, or trailer tires.  This Road Hazard Program only covers tires that are clearly listed on the original purchase invoice, while on the vehicle as detailed on the original purchase invoice, and covers only the original purchaser of the tires.  CONSEQUENTIAL AND INCIDENTAL DAMAGES ARE EXCLUDED:  Some States do not allow the exclusion or limitation of consequential or incidental damages, therefore such limitations may not apply to you.  No express guarantee is given other than that stated herein.  This Road Hazard Program gives you specific legal rights; you may have other rights, which vary from state to state. Our liability is limited to either a refund of the price you paid for the tire, or providing you with a replacement tire, at our option.
